Governing Law and Jurisdiction
The IMMODEL  Site is subject to Luxembourg law and falls under the exclusive jurisdiction of the Luxembourg courts.

PRIVACY POLICY - DATA PROTECTION 

The purpose of this text is to inform users of the website of the methods of collection, processing and use of their Personal Data and of their rights with regard to the protection of Personal Data with regard to the applicable provisions and more specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of personal data (the “GDPR”) and the law of August 1, 2018 on the general data protection regime (the “Law of August 1, 2018”).

1. Data controller

As part of the operation of this website (the "Website"), the real estate agency IMMODEL a brand of QUALIS Sàrl, established and having its registered office at 56 rue de Beggen, L-1220 Luxembourg _cc781905-5cde- 3194-bb3b-136bad5cf58d_ (the "Agency"), is required to process certain Personal Data of users of the Website (the "Users").

The Agency determines the purposes and means of the Data processing carried out in accordance with the GDPR and the Law of 1 August 2018. As such, the Agency is responsible for the Data processing carried out.

2. Data collected and processing carried out

The Agency collects two types of Personal Data:

2.1 The Data that the User communicates directly to the Agency. 

The Agency may collect Data provided by the User when the latter completes a contact form. If the User wishes to receive additional information concerning an announcement, the Data collected will be: surname, first name, email, telephone number.

The User will be able to submit a rental application file. In this case, he will be required to provide information concerning his personal situation and that of his household (his spouse, the number of dependent children), his professional situation (such as his job, his level of income, etc. ). These Data are intended to constitute a file with a view to renting a property offered by the Agency. 

The User will have the possibility of obtaining an estimate of his property intended for sale. In this context, he will be required to provide the Data relating to the property for sale.

If the User decides to subscribe to the Agency's newsletter, his email address will be collected and processed. The User may at any time decide to unsubscribe from the newsletter by contacting the Agency or by using the link when receiving each newsletter.

2.2. Data collected indirectly by the Agency.

As part of the navigation on the Website, the Agency may collect a certain amount of Navigation Data. This includes Connection Data such as the date, time of connection, browser type and IP address.

3. Purposes of Data processing and legal basis

The Data provided by the User when filling out a form is necessary to respond to the User's request. They will not be used for other purposes without his prior consent.

Browsing Data is collected in order to analyze and measure the quality of User browsing on the Website. The User has the option of accepting or refusing the collection of Browsing Data.

The legal basis for the processing of Data carried out by the Agency is the consent of the person concerned (article 6.1.a) of the GDPR). In general, the Agency does not collect User Data without their prior consent. 

4. Communication of Data

The Agency does not transfer User Data to third countries within the meaning of the GDPR, i.e. outside the European Union.

The Agency may be compelled to disclose the Data to comply with the laws in force or at the request of an authority, or in the context of legal proceedings, for example to respond to complaints and/or claims, to protect the rights or interests of the Agency or its clients.

5. Data security and retention

The Agency takes all the precautionary measures, the appropriate technical and organizational measures to ensure the security, integrity and confidentiality of User Data and in particular, to prevent it from being distorted, damaged or that third parties not authorized have access. However, the Agency cannot guarantee the elimination of all risks and in particular the risks associated with the use of the Internet. 

The Agency will inform the data subjects as soon as possible in the event of a breach of Personal Data which is likely to create a high risk for their rights and freedoms, in accordance with Article 34 of the GDPR.

The Agency retains the Data for a period not exceeding that necessary with regard to the purposes for which they are processed. Thus the Data provided by the User when filling out a form will not be kept for longer than six months if no action is taken. 

At the end of this period, the Agency will delete or anonymize the Data, unless the Agency is subject to a legal obligation to retain the Data for a longer period.

6. User Rights

Users are informed that they have the following rights:


The right of access to Data: the User can request at any time to obtain access to the Data concerning him as well as a copy of this Data – the Agency reserves the right to ask the User to prove his identity ;


The right to request rectification of Data: the User may at any time request that inaccurate or incomplete Data be rectified;


The right to request the deletion of Data: the User may request that his Data be deleted when, for example, the Data is no longer necessary for the purposes for which it was collected or processed;


The right to request a limitation of the processing which concerns them: the User may request that the Agency restrict the processing of Data if, for example, the User disputes the accuracy of the Data concerning him or if he opposes the processing of Data concerning him;


The right to Data portability: the User has the right to have their Data transferred to another controller in a structured, commonly used and machine-readable format, if the processing is carried out by automated means or if it is based on prior consent;


The right to object to the processing of Data: the User may object to the processing of his Data, and he may withdraw his consent if the processing is based on consent, for example if the Data is used for the purposes of commercial prospecting. 

Users may contact the Agency to exercise their rights or to obtain more information concerning the processing of their Personal Data, at the following email address: contact@immodel.lu The Agency will respond within a maximum period of one month.

Users are also informed that if they are not satisfied with the Agency's response to one of their requests or with the way the Agency processes the Data, they have the right to lodge a complaint with a supervisory authority (the National Commission for Data Protection in Luxembourg – CNPD –  www.cnpd.public.lu ).

Third-party applications – social networks : the Agency may use third-party applications that allow the User to share content such as a real estate ad, on social networks Facebook, Twitter, Google, Google+ , Youtube, LinkedIn, Pinterest and Instagram. 

These social networks are likely to identify the User when he clicks on one of the buttons to share content via his user account, or when he visits the Website if he is connected to the user account of the social network in question. 

The Agency does not control the process used by social networks to collect Data relating to the User's browsing on the Website. The User is therefore invited to consult the privacy policy of the social network used by clicking on one of the links below in order to know the Browsing Data collected and the use made of it._cc781905-5cde-3194 -bb3b-136bad5cf58d_
